Portsea Swim Classic 2010

1. I understand that the Portsea Swim Classic (the “event”) is an open water swim of approximately 1.2 kilometres length and as such it is a physically strenuous and demanding swim. I understand that only swimmers who have trained for the event and can complete the course in under 40 minutes should enter. It has been recommended that I should wear a wetsuit.

2. I agree to be bound by the official rules and regulations of the event.

3. I hereby consent to receive medical treatment that may be thought advisable by a registered medical practitioner or paramedical practitioners and personnel in case of injury and/or illness during the event.

4. I hereby agree that if the event is cancelled due to storm, rain, inclement weather, winds or other ‘Act of God’ conditions or safety concerns, or if I do not participate in the event for any other reason, my entry fee shall be non-refundable.

5. I acknowledge that I have been advised that participation in the event involves a risk of injury, death and financial loss and that my participation in the event (or of any person under my legal responsibility) is at my own risk and to the maximum extent permitted by law, I hereby release and forever discharge Portsea Surf Life Saving Club Limited (PSLSC) and its members, event sponsors and their employees, representatives, members and agents, Commonwealth and State Departments.

6. I consent to PSLSC, the sponsors of the event or third parties appointed by them to use, without restriction, any images, film, sound recording or photographs captured or taken before, during or after the event without compensation. I am aware that I am not permitted to display any advertising, or marketing identification of any sponsor that is in competition with the event sponsors.

7. I consent to PSLSC, including its volunteer medical staff, collecting health information about me before or during any treatment given to me in the course of the event for the purposes of providing medical treatment or first aid.

8. If any part of a provision of this agreement is void or unenforceable that part shall be severable and not affect the enforceability of the remaining provisions.

PSLSC collects personal information about you for the purposes of:

• organising and administering this and future events, including assessing your qualification in the entry field, determining the starting groups and appointing and briefing of volunteer medical staff and marshals required to run the event;

• providing medical treatment or first aid to you, if required;

• publishing result-times and place-finishes in newspapers and other publications;

• contacting you to attend or assist with future events and other functions arranged by PSLSC; and

• contacting any family members or friends nominated by you to be contacted in case of an emergency.

PSLSC discloses your health information to volunteer medical staff who provide health services and medical treatment at events. We also disclose your name, post code, result-time and place-finish to publishers of newspapers, such as The Sunday Age.

If you do not provide all the information requested by PSLSC we cannot accept your entry into the event. If you do not provide all the health information requested by the volunteer medical staff they may not be able to provide you with adequate

The information on this form is collected for the primary purpose of registering you as a TeamMONASH™ participant for the Portsea Swim Classic. Other purposes of collection include correspondence regarding the event and keeping you informed of any changes. If you choose not to complete all the questions on this form, it may not be possible for Monash Sport to process your registration. Personal information may also be disclosed to the Portsea Swim Classic event organisers.

You have a right to access personal information that Monash University holds about you, subject to any exceptions in relevant legislation. If you wish to seek access to your personal information or inquire about the handling of your personal information, please contact the University Privacy Officer via email.

Please note that as being part of TeamMONASH™ photos may be taken of you at the pre-event function and event. These photos may be used for promotional purposes and an online image gallery.
